<br />I <br /> <br />4 <br /> <br />If a resIdence, church, public school, or public hospital locates wIthm 300 feet <br />of an establIshment WIth a T.^...BC CondItIonal Use Permit after the permIt IS <br />Issued, the permItted establIshment shall not be consIdered to be out of <br />compliance WIth thIS chapter <br /> <br />SECTION 4. Subsection 4.34.2(b)(3) of the CIty Land Development Code IS <br />amended as follows (underlmmg mdIcates added text; overstrike indIcates deleted text) <br /> <br />(3) Issuance to holder of state permIt. The ConditIOnal Use PermIt shall be Issued <br />only to and for the benefit of the holder of an alcoholIc beverage lIcense--.m: <br />permIt Issued by the state for the place of busmess and premIses for whIch the <br />T.^...BC CondItIonal Use Permit IS requested. <br /> <br />SECTION 5. SubsectIOn (b)(5) of SectIOn 4.34.2 of the CIty Land Development <br />Code IS amended as follows (underlimng mdIcates added text; oyerstrike mdIcates deleted <br />text) <br /> <br />(5) Revocation. <br /> <br />a. <br /> <br />The Plannmg DIrector shall cause a revocation hearmg to be scheduled <br />before the CommIssion m accordance WIth the same procedures as for <br />mItIal conSIderatIOn of a CondItIonal Use PermIt when eIther of the <br />followmg SItuatIOns occur These prOVlSlons supersede any conflIctmg <br />provlSlons m Chapter 1, ArtIcle 5 <br /> <br />I <br /> <br />1 An establIshment havmg a valId T.^...BC CondItIonal Use PermIt <br />violates any proVIsion of this Chapter. or any proVIsion of the <br />permIt, includmg condItIons established by the CommISSIOn in <br />approvmg the CondItIonal Use P 12ermit whIch may not <br />otherwIse be addressed in the mandatory standards enumerated <br />in subsectIOn (b )(2) of thIS sectIOn. <br /> <br />2. <br /> <br />An establIshment havmg a valId T.^...BC CondItIonal Use PermIt <br />accumulates at any tIme dunng an 18 month consecutIve <br />penod any combmation of confirmed violations of the <br />standards whIch totals SIX or more of the weighted VIOlation <br />values shown m parentheses at the end of each enumerated <br />standard m subsectIOn (b )(2) of thIS section. ViolatIons of the <br />standards shall be mvestIgated, documented, confirmed, and <br />filed by the Plannmg DIrector or a CIty officer The Plannmg <br />DIrector shall notIfy the permIt holder by certIfied maIl, return <br />receipt requested, of each assessment of VIOlatIOn values. If the <br />permit holder dIsagrees WIth the assessment, the permIt holder <br />may file a written appeal with the Director within 15 calendar <br /> <br />I <br /> <br />3 <br />
