<br />(J <br /><) <br /> <br />gJ ~~INANCE OF mE C:::::::N:~ TIlE CITY OF SAN MARCOS, TEXAS, <br />U~o r-IAQi:j::>RIZING THE ISSUANCE AND SALE OF CITY OF SAN MARCOS, TEXAS, <br />~ CBINATION TAX AND REVENUE CERTIFICATES OF OBLIGATION, SERIES 2000; <br />1oc.^1l1 P I8J>ING FOR THE SECURITY FOR AND PAYMENT OF SAID CERTIFICATES; <br />r III ~ p.. ~RIBING THE FORM OF SAID CERTIFICATES; AWARDING THE SALE THEREOF; <br />D~ f{ ~IOVING THE OFFICIAL STATEMENT; ENACTING OTHER PROVISIONS RELATING TO <br />~ cj::' T~UBJECT; AND DECLARING AN EMERGENCY <br />U,Ot 0 f:d~ <br />~j . - :C.CJ ""'"''' ..... <br /> <br />~; ~ 5i WHEREAS, the City Council (the "City Council") of the City of San Marcos, Texas (the "City"), <br />by resolution adopted on January 10,2000, directed publication of notice of the City's intention to issue a <br />maximum principal amount not to exceed $1,500,000 certificates of obligation of the City for the purposes <br />hereinafter set forth; <br /> <br />WHEREAS, such notice was published in the manner and to the extent required by law; <br /> <br />WHEREAS, there has not been filed with the City Secretary or any other officer of the City a petition <br />protesting the issuance of such certificates of obligation and requesting an election on same; and <br /> <br />WHEREAS, it is affirmatively found and determined that the City is authorized to proceed with the <br />issuance and sale of such certificates of obligation as authorized by the Constitution and laws of the State <br />of Texas, including, particularly, Tex. Loc. Gov't Code Ann. ch. 271, subch. C, and Tex. Gov't Code ch. <br />1502; Now, Therefore <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS: <br /> <br />ARTICLE I <br /> <br />DEFINITIONS AND OTHER PRELIMINARY MATTERS <br /> <br />Section 1.01. Definitions. <br /> <br />Unless otherwise expressly provided or unless the context clearly requires otherwise, in this <br />Ordinance the following terms shall have the meanings specified below: <br /> <br />"Certificate" means any of the Certificates. <br /> <br />"Certificates" means the City's certificates of obligation entitled "City of San Marcos, Texas, <br />Combination Tax and Revenue Certificates of Obligation, Series 2000" authorized to be issued by Section <br />3.01 of this Ordinance. <br /> <br />"Closing Date" means the date of the initial delivery of and payment for the Certificates. <br /> <br />"Code" means the Internal Revenue Code of 1986, as amended, including applicable regulations, <br />published rulings and court decisions relating thereto. <br /> <br />RISANMARICO.OO\Docs\FINALIORDCO.
