A general and special election is ordered to be held by the City of San Marcos <br />(the "City"), at the various polling places and election precincts within the corporate limits of the <br />City, as hereinafter designated, on May 6, 2000 from the hours of7:00 a.m. to 7:00 p.m., at which <br />election there shall be elected by the qualified voters of the City, a Mayor for a term of two years, <br />a City Council Member for Place 5, and a City Council Member for Place 6, for terms of three years <br />each, and at which election there shall be submitted to the qualified voters of the City, ballot <br />propositions for proposed amendments to the City Charter and a non-binding proposition for the <br />City's acquisition of the Aquarena Springs property from the State of Texas, in accordance with <br />applicable provisions of the City Charter and State law. <br /> <br />SECTION 2. The following measures will be submitted to the qualified voters of the City <br />at the election, in accordance with Section 9.004 of the Texas Local Government Code and Sections <br />12.11 and 12.12 of the San Marcos City Charter and other applicable laws: <br /> <br />MEASURE NO.1 <br /> <br />SHALL SECTIONS 2.03 AND 2.04 OF THE CITY CHARTER BE AMENDED TO READ <br />AS FOLLOWS: <br /> <br />Sec. 2.03. Extension or detachment of boundaries. <br /> <br />The city council shall have power by ordinance to fix the boundary limits of the City <br />of San Marcos and to provide for the alteration and extension of boundary limits, the <br />detachment of territory and the annexation of additional territory, in accordance with <br />applicable state annexation laws. <br /> <br />Sec. 2.04. Limited purpose annexation. <br /> <br />In addition to the power to annex additional territory for all purposes, the city shall <br />have the power, by ordinance, to fix, alter and extend the corporate boundary limits of the <br />city for the limited purposes of "planning and zoning" and "sanitation and health <br />protection," and to annex for one or both of such limited purposes additional territory lying <br />adjacent to the city; provided, however, that no such territory which lies farther than one mile <br />from the corporate boundary limits enclosing the territory which is a part of the city for all <br />purposes, as those corporate boundary limits are now or may hereafter be established, shall <br />be annexed for any limited purpose or purposes. Wherever the boundary limits of territory <br />annexed for one or both of such limited purposes are not coterminous with the corporate <br />boundary limits enclosing the territory which is a part of the city for all purposes, such <br />boundary limits of the limited territory shall be known as "limited purpose boundary limits". <br />Every ordinance by which territory is to be annexed to the city for one or both of such limited <br />purposes shall state clearly the limited purpose or purposes for which it is being annexed, and <br />shall be published one time, in a newspaper of general circulation in the city and in the form <br /> <br />1 <br />
