<br />provided that any such action for expulsion of a city council member shall require five <br />affirmative votes of city council members. <br /> <br />(b) The city council shall have the authority to remove any city official appointed or <br />approved by the city council. Any such removal of a city official by the city council shall <br />require a majority vote of the membership of the city council and shall be preceded by <br />adequate notice to the official of the time and location of the meeting, the nature of the <br />charge against the official, and an opportunity for a hearing. At any such hearing, evidence <br />both for and against the city official may be offered for the council's consideration. The <br />council may, by ordinance, provide for further or more detailed procedures pertaining to the <br />removal of city officials, not inconsistent with this provision. <br /> <br />MEASURE NO.8 <br /> <br />SHALL SECTION 4.02 OF THE CITY CHARTER BE AMENDED TO READ AS <br />FOLLOWS. AND SHALL ALL REFERENCES IN THE CHARTER TO THE "CITY <br />SECRETARY" BE CHANGED TO READ "CITY CLERK": <br /> <br />Sec. 4.02. City clerk. <br /> <br />The city council shall appoint a city clerk, who shall give notice of council meetings, <br />shall keep the minutes of the proceedings of such meetings, shall authenticate by signature <br />all ordinances and resolutions, and shall perform such other duties as the city manager, with <br />the consent of the city council, shall assign and those elsewhere provided for in this Charter. <br />The city clerk's compensation shall be fixed by the city council. The city clerk may appoint <br />an assistant or assistants with the approval of the council. <br /> <br />MEASURE NO.9 <br /> <br />SHALL SECTION 5.07 OF THE CITY CHARTER BE AMENDED TO READ AS <br />FOLLOWS: <br /> <br />Sec. 5.07. Conducting and canvassing elections. <br /> <br />The returns of every municipal election shall be delivered by the election judges to the <br />central counting station immediately after the closing of the polls. Returns of the elections, <br />general and special, shall be presented to the city council on any date permitted by the Texas <br />Election Code at which time the council shall canvass and declare the results of such <br />election. <br /> <br />MEASURE NO. 10 <br /> <br />SHALL SECTIONS 6.01 AND 6.02 OF THE CITY CHARTER BE AMENDED TO READ <br />AS FOLLOWS: <br /> <br />Sec. 6.01. Power of initiative. <br /> <br />The people of the city reserve the power of direct legislation by initiative, and in the <br />exercise of such power may propose any ordinance or repeal any ordinance not in conflict <br />with this Charter, the state Constitution, or the state laws. Any initiated ordinance may be <br />submitted to the council by a petition signed by at least ten per cent of the qualified voters <br />of the city. <br /> <br />Sec. 6.02. Power of referendum. <br /> <br />The people reserve the power to approve or reject at the polls any legislation enacted by <br />the council which is subject to the initiative process under this Charter. Prior to or within <br />thirty days after the effective date of any ordinance which is subject to referendum, a petition <br />by at least ten per cent of the qualified voters of the city may be filed with the city secretary <br /> <br />-5- <br />
