<br />TEXAS DEPARTMENT OF TRANSPORTATION <br /> <br />AIRPORT PROJECT PARTICIPATION AGREEMENT <br /> <br />(Federal Assisted Airport Development) <br /> <br />Amendment No. 01 to the Agreement <br /> <br />TxDOT CSJNo.: 0014SMRCO <br />TxDOT Contract No.: OXXF A040 <br />TxDOT Project No.: AP San Marcos 1 <br /> <br />WHEREAS, the City of San Marcos, hereinafter referred to as the "Sponsor", and the <br />Texas Department of Transportation, hereinafter referred to as the "State," have entered into an <br />Airport Project Participation Agreement TxDOT CSJ Number 0014SMRCO, executed by the <br />Sponsor on October 12, 1999, and by the State on November 22, 1999, for the development of <br />the San Marcos Municipal Airport; and <br /> <br />WHEREAS, the project is described as follows: prepare an Airport Master Plan for the <br />San Marcos Municipal Airport; and <br /> <br />WHEREAS, it is in the mutual interest of the Sponsor and the State to amend said Airport <br />Project Participation Agreement at this time to change the financial assistance from state to <br />federal; attach federal assurances as required; and increase the amount of financial assistance <br />based on the final negotiated fees; and <br /> <br />WHEREAS, Part II - Offer of Financial Assistance, estimates total project costs to be <br />$120,000; and <br /> <br />WHEREAS, financial assistance IS currently limited to $108,000 In state funds and <br />$12,000 in local sponsor funds; <br /> <br />NOW THEREFORE, pursuant to and for the purpose of carrying out the provisions of <br />Title 49 D.S.C., and in consideration of (a) the Sponsor's adoption and ratification of the <br />representations and assurances contained in said Airport Project Participation Agreement and its <br />acceptance of this Offer as hereinafter provided, and (b) the benefits to accrue to the United <br />States and the public from the accomplishment of the project and compliance with the assurances <br />and conditions as herein provided, THE TEXAS DEPARTMENT OF TRANSPORTATION, <br />FOR AND ON BEHALF OF THE UNITED STATES, FEDERAL AVIATION <br />ADMINISTRATION (HEREINAFTER REFERRED TO AS THE "FAA"), HEREBY <br />OFFERS AND AGREES to pay, as the United States share of the allowable costs incurred in <br />accomplishing the project, ninety percentum of all allowable project costs.
