<br />58. <br /> <br />RESOLUTION 2000- ~R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING THE TERMS AND <br />CONDITIONS OF AN OVERSIZE REIMBURSEMENT <br />AGREEMENT BETWEEN THE CITY AND U.S. <br />PROPERTIES; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE THE AGREEMENT ON BEHALF OF THE CITY; <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City Council desires to participate in the overslzlng of wastewater <br />improvements being constructed to serve Lot 3, Section 1 of the McKinley Place <br />Subdivision, as described in the attached Agreement, in accordance with the requirements <br />of Section 110.131 of the Subdivision Chapter of the City Code. <br /> <br />2. It is necessary to establish the terms of the City's participation in the oversizing <br />of these wastewater improvements. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS; <br /> <br />PART 1. The terms and conditions of the attached Oversize Reimbursement <br />Agreement between the City of San Marcos and U.S. Properties for the oversizing of <br />wastewater improvements being constructed to serve Lot 3, Section 1 of the McKinley <br />Place Subdivision are approved. <br /> <br />PART 2. The City Manager, Larry D. Gilley, is hereby authorized to execute the <br />Agreement on behalf of the City. <br /> <br />PART 3.
