<br />subsequent owner of the Hardware. but aot otherwise. subject 10 the
<br />paymcol of the thea current liceDse fee for oew users. iC allY. No such
<br />assignmeol shall be valid uotil CUSTOMER (I) has delegaled all of iu
<br />obligaLioa.s under this Li~nse to the assignee; and (2) has obtained from the
<br />assigoee an uncooditiooal wnlleo a.ssumptioo of all such obligal.ioos; ~d 0)
<br />has provided NTl a copy of such assignment, delegation and assumption;

<br />CUSTOMER through this License arc assignable. Any attfmpted

<br />THE BODY OF THE AGREEME~7 TO WHICH THIS LICENSE IS
<br />ATTACHED OR, I~ THE CASE OF LICENSED SOFTWARE
<br />DISTRIBli"TED IN A SEALED DISK PACKAGE. THOSE WHICH
<br />APPEAR AT THE. E..'\1l OF THIS LICENSE AGREEME.'\"T. OTHER
<br />THAN AS SET FORTH THERElN, THIS LICENSE DOES NOT
<br />CONFER OR GRA~"T ANY WARRANTY TO CUSTOMER FROM
<br />OR BY NTl; THE LICENSED SOFTWARE IS PROYlDED BY NTI"AS
<br />IS" AND WITHOli"T WARRANTY OF ANY KI!'Ill OR NATURE,
<br />WRITTEN OR ORAL, EXPRESS OR IMPLIED, INCLUDING
<br />(WITHOUT LIMITATION) THE IMPLIED WARRANTIES OF
<br />MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR
<br />PURPOSE. THIS LIMITATION OF WARRANTIES WAS A
<br />lI-tATERlAL FACTOR IN THE ESTABLISHMENT OF THE LICENSE
<br />FEE CHARGED FOR EACH SPECIFIC ITEM OF SOFTWARE
<br />LICENSED;
<br />IN NO EVENT WILL 1\TI AND/OR NTI'S SUPPLIERS AND THEIR
<br />DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS BE LIABLE TO
<br />OR THROUGH CUSTOMER FOR INCIDENTAL, l/'.llIRECT,
<br />SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY
<br />DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOSS OF
<br />BUSINESS OR BUSINESS INFORMATION, BUSINESS
<br />INTERRUPTION, OR OTHER ECONOMIC DAMAGE, AND
<br />FURTHER INCLUDING IN1URY TO PROPERTY, AS A RESULT OF
<br />USE OR INABILITY TO USE THE LICENSED SOITWARE OR
