Womack , the duly qualified and acting City Secretary ofthe City of San Marcos, Texas, (the "City") do hereby certify, according to the records ofthe City Council of the City of San Marcos, Texas (the "Council") in my official position, as follows: 1. The City is a duly organized and existing City of the State of Texas under the Constitution and laws of said state. There has never been, and there is not now threatened or pending, any litigation of any kind questioning or affecting the organization or boundaries of the City or the pow~r of the City to levy taxes on all taxable property within the boundaries of the City. 2.
