<br />87. <br /> <br />Regular Meeting <br /> <br />December 7, 2005 <br /> <br />Page 5 <br /> <br />I <br /> <br />STAR FORD THROUGH THE TEXAS BUILDING AND PROCUREMENT COMMISSION, <br />AUTHORIZING THE PURCHASING MANAGER TO EXECUTE PURCHASING DOCUMENTS ON <br />BEHALF OF THE CITY, AND DECLARING AN EFFECTIVE DATE <br /> <br />Mayor Narvaiz introduced for consideration Item 17, removed from the <br />consent agenda, adoption of an Ordinance on third and final reading, the <br />caption which was read as follows <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 6, ANIMALS, OF THE CITY CODE BY ADDING SECTION 6 087 <br />REGARDING THE SAFETY OF ANIMALS IN MOTOR VEHICLES; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES <br /> <br />Mr Mihalkanin moved for adoption of the Ordinance on third and final <br />reading, and Mr Taylor seconded the motion Mr Taylor stated the City <br />veterinarians feel the leash law is a bigger problem than animals jumping <br />out of truck beds He stated he feels animals should not be tethered under <br />30 m p h and tethering can cause injury to animals Mayor Narvaiz stated <br />she feels this is an emotional issue She stated she randomly poled <br />citizens and 96% of the residents surveyed feel this proposed Ordinance is <br />evasive She stated she also contacted some veterinarians, and they feel <br />there is a bigger leash law problem Mr Taylor moved to amend Section <br />16 087(a) by adding at a speed greater than 30 m p h and deleting (b), and <br />Mr Mihalkanin seconded the motion Mayor Narvaiz stated she also <br />contacted the Police Department regarding accidents involving an animal in <br />truck beds She stated the Police Department could not remember writing an <br />accident report involving an animal falling out of a vehicle On roll call <br />for the amendment the following vote was recorded <br /> <br />AYE <br /> <br />Mihalkanin and Taylor <br /> <br />NAY <br /> <br />Diaz, Guerrero, Narvaiz, Thomaides and Bose <br /> <br />ABSTAIN <br /> <br />None <br /> <br />The motion for amendment failed Mr Mihalkanin moved to amend the caption <br />and Section 6 087(a) to add unless it is a farm vehicle, and Mr Thomaides <br />seconded the motion On roll call for the amendment the following vote was <br />recorded <br /> <br />AYE <br /> <br />Mihalkanin, Thomaides and Taylor <br /> <br />NAY <br />I ABSTAIN <br /> <br />Diaz, Guerrero, Narvaiz and Bose <br /> <br />None <br />
