<br /> <br />.~.'.;I: <br /> <br />~ ~ <br />~ <br />~ <br />c::::> <br />c--." <br /> <br />I <br /> <br />I <br /> <br />C) <br /> <br />; <br /> <br /> <br />B,~ <br />~~~I <br />cr: ...- . _ <br />w""- <br />--lZ , <br />CLc::( Yi <br />)-_ if) .' <br />}--l.L..~ <br />-"'::0 <br />--.II <br />;: I I <br />>- <br />(.) a::. <br /> <br />109. <br /> <br />(1) <br /> <br />ORDINANCE NO 2005----9..4... <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, APPROVING AN <br />AMENDMENT TO THE FUTURE LAND USE MAP <br />FROM LOW DENSITY RESIDENTIAL TO MIXED <br />USE FOR A 0 26 ACRE TRACT OF LAND LOCATED <br />AT 504 BURLESON STREET, AMENDING THE <br />OFFICIAL ZONING MAP OF THE CITY BY <br />REZONING THIS TRACT FROM "R-1" SINGLE- <br />FAMILY DWELLING DISTRICT (LOW DENSITY) <br />("SF-6") TO "MU" MIXED USE DISTRICT, <br />INCLUDING PROCEDURAL PROVISIONS, AND <br />PROVIDING FOR PENALTIES <br /> <br />RECITALS <br /> <br />1 On July 12, 2005, the City Planning and Zoning Commission held a <br />public hearing regarding a City-wide rezoning map, including corresponding <br />changes to the Future Land Use Map of the San Marcos Horizons City Master <br />Plan, and in connection with the City-wide rezoning map, the Commission <br />considered a change in the future land use designation from Low Density <br />Residential to Mixed Use for a 026 acre tract of land located at 504 Burleson <br />Street (the "Subject Tract"), and subsequent to the public hearing, the <br />Commission voted to approve the change in future land use designation for the <br />Subject Tract, and recommended that the change be approved by the City <br />Council of the City <br /> <br />2 On October 11, 2005, the Planning and Zoning Commission of the City <br />of San Marcos held a public hearing regarding an application to change the <br />zoning from "R-1" Single-Family Dwelling District (Low Density) ("SF-6" in the <br />City Land Development Code) to "MU" Mixed Use District, for the Subject Tract, <br />and subsequent to the public hearing, the Commission considered and voted to <br />approve the application, and recommended that the application be approved by <br />the City Council <br /> <br />3 The City Council held a public hearing on December 7. 2005 <br />regarding the change in future land use designation and the zoning change <br />recommended by the Planmng and Zoning Commission for the Subject Tract. <br /> <br />4 All requirements of Chapter 1, Development Procedures, of the City <br />Land Development Code pertaining to Future Land Use Map Amendments and <br />Zoning Map amendments have been met. <br /> <br />5 The City Council hereby finds and determines that the adoption of the <br />following ordinance is in the interest of the public health, morals, welfare and <br />
