<br /> <br />I <br /> <br />I <br /> <br />!n <br />a <br />(1) <br /> <br />(; ~ <br />0, j <br />(,j . )-)f <br />~(~...[ <br />cc~~:\ <br />w~'- - <br />_J:;::O: "'"1 <br />U< /'l <br />'_u:;o"'y" . <br /> <br />~~~5 /~r <br />'-.J '-i! j <br />~- \1 t <br />r--~ <br />"- <br />c.) ~ <br /> <br />ORDINANCE NO 2005-~ <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, APPROVING AN <br />AMENDMENT TO THE FUTURE LAND USE MAP FROM <br />LOW DENSITY RESIDENTIAL TO MIXED USE FOR A 0 61 <br />ACRE TRACT OF LAND LOCATED AT 1425 RANCH <br />ROAD 12, AMENDING THE OFFICIAL ZONING MAP OF <br />THE CITY BY REZONING THIS TRACT FROM "R-1" <br />SINGLE-FAMILY DWELLING DISTRICT (LOW DENSITY) <br />("SF-6") TO "MU" MIXED USE DISTRICT, INCLUDING <br />PROCEDURAL PROVISIONS, AND PROVIDING FOR <br />PENALTIES <br /> <br />11 3 . <br /> <br />:i:: <br />~ <br /> <br />r- <br /> <br />::> <br />C) <br />z <br />U":l <br />c:::::. <br />c:::::. <br />C"-I <br /> <br />RECITALS <br /> <br />1 On July 12, 2005, the City Planning and Zoning Commission held a public <br />hearing regarding a City-wide rezoning map, including corresponding changes to the <br />Future Land Use Map of the San Marcos Horizons City Master Plan, and in connection <br />with the City-wide rezoning map, the Commission considered a change in the future <br />land use designation from Low Density Residential to Mixed Use for a 0 61 acre tract of <br />land located at 1425 Ranch Road 12 (the "Subject Tract"), and subsequent to the public <br />hearing, the Commission voted to approve the change in future land use designation for <br />the Subject Tract, and recommended that the change be approved by the City Council <br />of the City <br /> <br />2 On October 11,2005, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding an application to change the zoning from "R-1" <br />Single-Family Dwelling District (Low Density) ("SF-6" in the City Land Development <br />Code) to "MU" Mixed Use District, for the Subject Tract, and subsequent to the public <br />hearing, the Commission considered and voted to approve the application, and <br />recommended that the application be approved by the City Council <br /> <br />3 The City Council held a public hearing on December 7, 2005 regarding <br />the change in future land use designation and the zoning change recommended by the <br />Planning and Zoning Commission for the Subject Tract. <br /> <br />4 All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br /> <br />5 The City Council hereby finds and determines that the adoption of the <br />following ordinance is in the interest of the public health, morals, welfare and safety <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS <br />
