RESOLUTION NO 2005-~R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE CITY'S PARTICIPATION IN THE AUSTIN SAN ANTONIO INTERMUNICIPAL COMMUTER RAIL DISTRICT, AND DECLARING AN EFFECTIVE DATE. RECITALS 1 The cIties of San AntOnIO and Austm created the Austm San AntOnIO IntermUnIClpal Commuter Rail Dlstnct (the "Rail Dlstnct") m February of 2003, pursuant to Article 6550c-l, SectIOn 2, Texas RevIsed CIvIl Statutes. 2 The purpose of the RaIl Dlstnct IS to Implement and operate passenger commuter rail serVIce m a corndor from San AntOnIO to Georgetown. 3 The Rail Dlstnct Board of DIrectors recently accepted a study whIch concluded that passenger commuter rail servIce m the Rail Dlstnct IS technIcally and finanCially feasible 4 The RaIl Dlstnct has mVlted cIties and counties m the RaIl Dlstnct area to become a part of the Rail Dlstnct, and partICIpate m the plannmg, constructIOn, financmg and operatIOn of commuter raIl servIce 5 The CIty CouncIl wIshes to have the CIty of San Marcos become a part of the Rail Dlstnct. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS P ART 1 The CIty of San Marcos elects to become a part of the Austm San AntOnIO IntermunIclpal Commuter Rail Dlstnct, pursuant to ArtIcle 6550c-l, SectIOn 2, Texas ReVIsed CIVIl Statutes, effective on December 7, 2005 PART 2 The payment of $49,50000 to the Austin San AntOnIO Intermuniclpal Commuter RaIl DIstrict for the penod of the District's fiscal year, October 1, 2005 through September 30, 2006, is approved. PART 3 John Thomaides , an elected member of the CIty CounCIl of the CIty of San Marcos, IS appomted to the Board of DIrectors of Austm San AntOnIO Intermunlclpal Commuter Rail Dlstnct. PART 4 ThIS ResolutIOn IS m full force and effect Immediately from and after ItS passage ADOPTED on December 7, 2005.
