Sec. 70.102. Planning and zoning commission review process. <br />Sec. 70.103. City council review and action period. <br />ARTICLE 1. IN GENERAL <br />Secs. 70.001 -- 70.025. Reserved. <br />ARTICLE 2. UTILITY DISTRICTS* <br />DIVISION 1. GENERALLY <br />Sec. 70.026. Out of district service requests for utility districts. <br />(a) The review process in this section for out of district service request for utility districts <br />is established. <br />(b) Petitions for out of district service for a utility district shall be reviewed by the staff <br />and planning and zoning commission prior to city council action. The request shall be filed with <br />the city clerk. Upon receipt of the filed request, the city clerk shall immediately inform the city <br />council, the ehair -.. of the planning and zon eemmission, and the city manager. The <br />recommendations of the staff and commission shall be forwarded to the city council for <br />consideration within 30 days of the filing. <br />Sec. 70.027. Fees established. <br />Under this article, a n initial fee in the amount of five thousand dollars ($5,000.00) shall <br />accompany the pre - application review request of any MUD petition. The petitioner shall <br />reimburse the city for expenses incurred by the city in connection with the city's consent to <br />formation of the district, including but not limited to professional fees incurred in connection <br />with the review, negotiation and preparation of the consent resolution, consent agreement, <br />development agreement, o r- the Feview of ^rea4io ° °reefne ° impact statements and plans of <br />any proposed or newly formed political subdivision authorized to be created by V z�., the <br />Texas Water Code is established by the city council. <br />
