The specification of coverage limits in this section does not limit Licensee's indemnity obligations under Article 16 in any way. Section 18.03. The Licensee will maintain fire and extended coverage property insurance on the Licensee's Facilities that may be placed on, within, or near City Facilities. This insurance must contain a waiver of subrogation as to the City. Section 18.04. The insurer on all coverages maintained by the Licensee must be authorized to do business in the State of Texas and have an "A" or better rating in the most recent Best's Guide. All contractors and all of their subcontractors who perform work on behalf of the Licensee will carry, in full force and effect, worker's compensation, comprehensive public liability and automobile liability insurance coverages of the type and amounts that the Licensee is required to obtain under this Article. Section 18.05. All liability coverages maintained by the Licensee and by the Licensee's contractors and subcontractors must name the City as an additional insured. All of the Licensee's insurance will be primary over any coverages maintained by the City. Section 18.06. Prior to the execution of this Agreement, and prior to each insurance policy expiration date during the term of this Agreement, the Licensee will furnish the City with a current certificate of insurance and upon request, certified copies of the Licensee's insurance policies. The Certificate will reference this Agreement and the worker's compensation and property insurance waiver of subrogation required by this Agreement. The certificate must verify that the City will be given 30 days advance notice of any cancellation or nonrenewal of coverage. All policies, other than worker's compensation, will be written on an occurrence and not on a claims -made basis. Section 18.07. The limits of liability set out in this Article may be increased or decreased by mutual consent of the parties. Section 18.08. The policies of insurance required to be obtained by the Licensee or its contractors or subcontractors will not contain provisions that A. exclude coverage of liability assumed by the Licensee in this Agreement except as to infringement of patents or copyrights or for libel and slander in programming; B. exclude coverage of liability arising from excavating, collapse, or underground work; C. exclude coverage for injuries to the City's officers, employees or agents; D. exclude coverage of liability for injuries or damages caused by the Licensee's contractors or subcontractors or their employees, servants or agents; or E. contain a standard form pollution exclusion or exclude claims or suits that arise from the effects of electromagnetic fields or radiation (to the extent such coverage cannot be obtained through 19 CADocuments and Settings \tamara.slade \Local Settings\ "Temporary Internet Files \Content.Outlook \F3JWG5DH \San Marcos PAA_FINAL_CLEAN_I0 17 201 Ldocx
