16.7:OOPM - Receive Staff presentation and hold a Public Hearing to receive comments for <br />or against a request to annex 51.18 acres, located entirely in Hays County at 4440 Old <br />Stagecoach Road, into the City of San Marcos. <br />Matthew Lewis, Development Services Director, provided Council with a brief presentation on <br />this request. <br />Following the presentation Mayor Guerrero opened the Public Hearing at approximately 7:08 <br />p.m. <br />There being no comments, the Public Hearing was closed at 7:09 p.m. <br />No action was required from Council. <br />17.7:OOPM - Receive a Staff presentation and hold a Public Hearing to receive comments <br />for or against Ordinance 2011 -55 amending various sections of the Land Development <br />Code as follows: modifvine the appeals process for Certificates of Appropriateness under <br />Sections 1.5.5.6 and 1.10.1.4, modifvine the Platting Procedures for certain types of <br />Properties under Section 1.6.1.1; modifvine the procedures related to Watershed <br />Protection Plans under Sections 1.7.1.1 and 1.7.1.4; modifvine the requirements related to <br />Site Preparation Permits under Sections 1.8.1.1 and 1.8.1.3; clarifying the applicability of <br />Development Agreements to certain types of properties in the ETJ under Section 2 2 1 1 <br />modifvine lot width requirements for "MF -12" and "MF -18" Multiple - Family Residential <br />Districts under Sections 4.2.1.11 and 4.2.1.12; establishine a building height limit of four <br />stories for structures in "MU" Mixed Use Districts under Section 4.2.2.1; establishin a <br />new zoning district classification of "VMU" Vertical Mixed Use under Chapter 4, Article 2, <br />Division 2 and modifvine various tables under Chapter 4 to reflect this new zoning <br />designation; excepting lots in 11TH" Townhouse Residential Districts from the required lot <br />depth to width ratio under Section 6.7.2.1; modifying the requirements for sidewalks under <br />Section 7.4.2.3; changing the definitions of Major, Minor and Moderate Recharge Features <br />under Chapter 8; providing a savings clause; providing for the repeal of anv conflictine <br />provisions; and providing an effective date; and consider Ordinance 2011 -55, on the first of <br />two readings. <br />Matthew Lewis, Development Services Director, provided Council with a brief presentation. <br />Following the presentation Mayor Guerrero opened the Public Hearing at approximately 7:16 <br />p.m. <br />There being no comments, the Public Hearing was closed at 7:16 p.m. <br />MOTION: Upon a motion made by Council Member Terry and a second by Council Member <br />Scott the City Council voted (7) for and (0) opposed, to approve Ordinance 2011 -55 on the first <br />of two readings, as previously captioned. The motion carried unanimously. <br />
