RESOLUTION 2011 -127 R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AND AUTHORIZING THE SUBMISSION OF DOCUMENTS PERTAINING TO THE EDWARDS AQUIFER RECOVERY IMPLEMENTATION PROGRAM INCLUDING THE IMPLEMENTING AGREEMENT, THE FUNDING AND MANAGEMENT AGREEMENT, AND HABITAT CONSERVATION PLAN; AND DECLARING AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The San Marcos City Council hereby approves and authorizes the submission of the following documents and agreements, pertaining to the Edwards Aquifer Implementation Program, by the Edwards Aquifer Recovery Implementation Program Steering Committee. The agreements are understood to be in final draft form and subject to minor revision and technical legal reformatting prior to execution by the City Manager: A. Implementing Agreement by and among the Edwards Aquifer Authority, the City of New Braunfels, the City of San Marcos, the City of San Antonio acting by and through its San Antonio Water System Board of Trustees, Texas State University — San Marcos, Texas Parks and Wildlife Department and the United States Fish and Wildlife Service (to implement the Habitat Conservation Plan for the Edwards Aquifer Recovery Implementation Program); B. Edwards Aquifer Recovery Implementation Program Habitat Conservation Plan Funding and Management Agreement; C. Habitat Conservation Plan for the Edwards Aquifer Recovery Implementation Plan. PART 2. The City Manager is authorized to execute the agreements approved in Part 1 of this Resolution on behalf of the City. PART 3. A copy of the documents and agreements approved in Part 1 of this Resolution shall be made available to the public in the office of the City Secretary and the San Marcos Public Library. PART 4. This Resolution shall be in full force and effect immediately from and after its passage. ADOPTED on October 18, 2011. aniel Guerrero Mayor
