RESOLUTION 2011 -12 8 R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, REQUESTING THE EDWARDS AQUIFER AUTHORITY TO <br />CONTINUE ITS POLICY OF OFFERING MANAGEMENT FEE REBATES AS <br />A CONSERVATION INCENTIVE FOR WITHDRAWING LESS WATER FROM <br />THE AQUIFER THAN ALLOWED UNDER GROUNDWATER PERMITS; <br />REQUESTING THE AUTHORITY TO SUBMIT THE EDWARDS AQUIFER <br />HABITAT CONSERVATION PLAN, IMPLEMENTING AGREEMENT, AND <br />FUNDING AND MANAGEMENT AGREEMENT, AS APPROVED BY THE <br />CITY OF SAN MARCOS AND RECOMMENDED BY THE EARIP STEERING <br />COMMITTEE, TO THE UNITED STATES FISH AND WILDLIFE SERVICE <br />WITHOUT SUBSTANTIVE REVISIONS; AND DECLARING AND EFFECTIVE <br />DATE <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The San Marcos City Council hereby requests the Edwards Aquifer <br />Authority to continue its policy of offering rebates of aquifer management fees as a conservation <br />incentive to induce entities to withdraw less water from the aquifer than allowed under their <br />groundwater permits. <br />PART 2. The San Marcos City Council hereby requests the Edwards Aquifer <br />Authority to submit the Edwards Aquifer Habitat Conservation Plan, Implementing Agreement, <br />and Funding and Management Agreement, as approved by the City of San Marcos and <br />recommended by the EARIP Steering Committee, to the United States Fish and Wildlife Service <br />without substantive revisions. <br />PART 3.
