<br />.~ <br /> <br />8 - <br />c:s ...:::;- <br />U~o ~I <br />~ <br /> <br />-< <br /> <br />>~ <br />o:::e <br />~t;ll <br />G:j:a: <br />O:::c: <br />Ut;ll <br />u.J 0:; <br />CJ?_ <br />:>-0 <br />I-- ~ <br />C3~ <br /> <br />7. <br /> <br />ORDINANCE 2000- 35 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY ZONING A 53.989 ACRE TRACT OF <br />UNZONED PROPERTY LOCATED AT 50011H-35 SOUTH AS <br />"C" COMMERCIAL DISTRICT; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On March 28, 2000, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to zone as "C" Commercial District a <br />53.989 acre tract of unzoned property located at 5001 IH-35 South. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on March 28, 2000 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 8th <br />Mav , 2000, regarding the request. <br /> <br />day of <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to zone the following real property which is <br />presently unzoned as "C" Commercial District: <br /> <br />Street address: <br /> <br />5001 IH-35 South. <br /> <br />Size: 53.989 acres. <br /> <br />Legal description: See the metes and bounds description attached as Exhibit A. <br /> <br />Deed or plat reference: Volume 429, page 455, Real Property Records of Hays <br />County and Volume 1798, Page 47 of the Official Public Records of Hays County. <br /> <br />SECTION 2. The Future Land Use Plan of the San Marcos Horizons City Master <br />Plan is revised to conform to this zoning map amendment. <br /> <br />SECTION 3. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 4. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City. This ordinance will take effect upon <br />publication of this notice. <br /> <br />PASSED, APPROVED AND ADOPTED this 8thday of May , 2000, <br />subject to reconsideration at the next regular City Council meeting scheduled for <br />May 22, 2000. <br /> <br />Reconsidered yes no x <br />
