As further consideration for the suspension <br />of the Suspended Aquifer Rights by the City under this Agreement, and subject to paragraph 2.3 <br />above, the Authority agrees to waive all annual aquifer management fees assessed against the <br />City for the quantity of the Suspended Aquifer Rights. In the event the Citv withdraws an <br />Overage, the waiver of aquifer management fees will be rescinded for that year on each acre foot <br />of the Overage. The City will pay to the Authoritv the amount of any rescinded fee waiver <br />within 30 days after submitting an annual report to the Authority that shows an Overage in <br />withdrawals. Use of Funds. The CITY '.vill direetly apply all funds received from the <br />DISTRICT as Monthly Payments under this ,\greement solely and exclusively to the actual cost <br />of the surfaoe '.vater to be supplied to the CITY by GBR..^~ and dcli':ercd to the CITY. <br /> <br />3.
