On April 11, 2000, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "L1" Light <br />Industrial District to "C" Commercial District on a 37.2 acre tract located in the 1900 <br />block of Corporate Drive and to change the zoning from "L1" Light Industrial District to <br />"MF-2" Multi-Family District (Medium Density) for a 35.69 acre tract of property located <br />off of the 1900 block of Dutton Drive. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on April 11 , 2000 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 22nd <br />May , 2000, regarding the request. <br /> <br />day of <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code <br />pertaining to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the <br />following ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section <br />114.029 of the San Marcos City Code, is amended to rezone the following real <br />property, which is presently zoned "U" Light Industrial District, to "C" Commercial <br />District: <br /> <br />Street address: Adjacent to the 1900 block of Corporate Drive. <br /> <br />Siize: 37.2 acres. <br /> <br />Leqal description: See the metes and bounds description attached as Exhibit A. <br /> <br />Deed or plat reference: The parent tract is described in Volume 752, page 33, <br />Hays County Deed Records. <br /> <br />SECTION 2. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 3. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be <br />published in a newspaper of general circulation in the City. This ordinance will take <br />effect upon publication of this notice. <br />
