On April 11, 2000, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from ""MF-4" <br />Multi-Family District (High Density) and "c" Commercial District to "C-2" Heavy <br />Commercial District for a 4.09 acre tract of property located at 1326 IH-35 North. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on April 11, 2000 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 22nd <br />May , 2000, regarding the request. <br /> <br />day of <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code <br />pertaining to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of toe <br />following ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section <br />114.029 of the San Marcos City Code, is amended to rezone the following real property <br />which is presently zoned "MF-4" Multi-Family District (High Density) and "c" <br />Commercial District to "C-2" Heavy Commercial District: <br /> <br />Street address: <br /> <br />1326 IH-35 North. <br /> <br />Size: 4.09 acres. <br /> <br />Leqal description: Lot 3, Luis Gil Addition. <br /> <br />Deed or plat reference: Volume 3, page 383, Hays County Deed Records. <br /> <br />SECTION 2. The Future Land Use Plan of the San Marcos Horizons City Master <br />Plan is revised to conform to this zoning map amendment. <br /> <br />SECTION 3. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 4. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be <br />published in a newspaper of general circulation in the City. This ordinance will take <br />effect upon publication of this notice. <br />
