<br />Grande's facilities. <br /> <br />G. Grande will render efficient service, make repairs properly, and interrupt service only for good cause <br />and for the shortest time possible. Planned service interruptions will be preceded by notice to customers <br />and will occur during periods of minimum use of Grande's facilities by Grande's customers. <br /> <br />H. All installations and repairs made by Grande will be performed in a good, substantial, safe and <br />workmanlike manner. Grande will make all connections of wires, cables and equipment to customers' <br />residences and buildings in a manner that is waterproof and prevents access by insects and vermin. <br /> <br />I. Grande agrees to provide programming responsive to the City's needs and interest for Spanish <br />language programming. This programming shall consist of at least two Spanish language channels or <br />other Spanish cultural equivalents available at all times in the most popular service level offered by <br />Grande. <br /> <br />J. Grande will not hinder the retransmission of a signal transmitted by any broadcast or non-broadcast <br />service for the benefit of the hearing impaired. <br /> <br />K. Effective one year after Grande completes its system buildout.1 Grande will provide a report to the <br />City Manager within 15 days after the end of each calendar quarter that includes the following for the <br />preceding calendar quarter: <br /> <br />1. Grande's compliance with FCC customer service requirements, with previous one-year history, <br />in narrative, table and graph form; <br /> <br />2. The total number and the total duration of significant service interruptions, in narrative, table <br />and graph form. <br /> <br />L. Grande will not disclose personally identifiable information concerning any customer to any third <br />party without the prior written consent of the customer. Personally identifiable information will not <br />include any record of aggregate data which does not identify particular persons. <br /> <br />M. Grande will make programming decisions based on customer surveys, viewer feedback, and Grande's <br />commitment to programming that provides value and diversity to its customers. <br /> <br />Section 6. Provision by Grande of Facilities and Services to Public Entities. <br /> <br />A. Grande agrees to install at its expense all equipment necessary to enable local emergency <br />management officials to interrupt all television broadcasting on Grande's facilities, to the extent <br />permitted by law, for the purpose of making emergency management announcements. This equipment <br />is to be installed at a location designated by the City by the start-up date. <br /> <br />B. Grande will provide one channel for use by the City and one channel for educational entities to be <br />designated by the City. Included in the channels provided under this paragraph, Grande will make <br />available up to but not exceeding two channels of the cable television spectrum on the basic tier of <br />Grande's cable service. Grande may insert alternate programming on these channels when the channels <br />are not in use by the City or the designated educational entities. The City may advertise on any "bulletin <br />board" programming offered by Grande, free of charge, as programming time is available. <br /> <br />C. Grande will provide the City with equipment necessary to broadcast meetings, programs, and notices <br />on the City's dedicated channel. To accomplish this, Grande agrees to establish a fund equal to 4% of <br />its annual gross basic monthly service revenues collected in calendar year 2004. Grande will pay this <br />amount to the City no later than January 31, 2005. <br /> <br />D. Grande will provide cable service at the most popular service level and the highest speed Internet <br />service offered by Grande at no cost to each public school building within the City, and to all City <br />buildings. Grande's obligation is to provide service to each building location, with the costs of wiring <br />the locations in excess of one outlet to be borne by the agency served. <br /> <br />E. Grande will install fiber optic cabling to the City buildings specified on the attached Exhibit B by <br />December 31, 2002, and to the City buildings specified on the attached Exhibit C by June 1, 2005, all <br />at no cost to the City.
