<br />12. Medical expenses in connection with Experimental or investigational surgery or treatment. <br /> <br />13. With respect to Covered Persons who are eligible for coverage under Medicare, a benefit <br />otherwise payable to you under this Treaty shall be reduced by the amount of any similar Medicare <br />benefit so that the total reimbursements hereunder with respect to a Covered Person or his <br />dependents shall not exceed 100% of such person's actual expenses otherwise reimbursable under <br />this Treaty. It will be conclusively presumed that each Covered Person eligible for coverage under <br />Medicare became covered for all parts of Medicare to which he or she is entitled on the earliest <br />possible date and thereafter maintained such coverage in force. <br /> <br />14. Expenses resulting from heart, lung, heart-lung, liver or pancreas transplants unless specifically <br />added by amendment to this Treaty. <br /> <br />8. TREATY TERMINATION <br /> <br />This Treaty and all coverage hereunder will terminate upon the earliest of the following: <br /> <br />1. Except as provided in the Payment of Premium provision, at the end of any period for which the <br />premium is paid, and the subsequent premium is not paid. <br /> <br />2. Cancellation date under the terms of the Cancellation provision. <br /> <br />3. The Expiration Date of this Treaty. <br /> <br />4. The date of termination of the Plan. <br /> <br />5. The last day of the third consecutive month during which the number of employees enrolled in <br />the Plan is less than 25, unless We agree in writing, to continue coverage. <br /> <br />In addition to the Termination provisions listed above, this Treaty shall automatically terminate upon <br />cancellation of the agreement between you and your Administrator, unless We have prior to such <br />cancellation: (1) agreed in writing, to the successor Administrator; and (2) received a copy of the <br />agreement between you and your successor Administrator. If the Administrator you select has not <br />been approved by Us, we reserve the right to approve the Administrator, and if not approved by Us, <br />we reserve the right to cancel or not renew this Treaty. <br /> <br />9. RENEWAL <br /> <br />Coverage may be renewed for a subsequent Treaty Year by written acceptance by you of the renewal <br />terms offered by Us. <br /> <br />10. CONDITIONS <br /> <br />PREMIUM: The premium basis and rates for this Treaty shall be as stated in the Application. <br />Premiums payable by you for Specific Excess Coverage and Aggregate Excess Coverage shall be <br />based upon the actual number of Covered Units each month multiplied by the applicable Premium <br />rate. Upon expiration or termination of this Treaty, or coverage hereunder, the earned premium shall <br />be computed in accordance with the premium and exposure basis shown in the Application based on <br />the actual number of Covered Units each month. If the earned premium exceeds the premium paid, <br />you shall pay the excess to Us; if less, we shall return the unearned portion of premium paid to you, <br />subject to the minimum premium, if any, shown in the Application. <br /> <br />REVISED PREMIUM COMPUTATION: We reserve the right, subject to 31 days prior written <br />notice to you, to establish new terms and conditions to be effective upon the expiration of this Treaty. <br />An adjustment in premium due to an amendment of the Plan shall be due from the effective date of the <br />amendment. <br /> <br />8 <br />
