<br />AMERICAN NATIONAL INSURANCE COMPANY <br />One Moody Plaza. Galveston, Texas 77550 <br /> <br />AGGREGATE ACCOMMODATION AGREEMENT <br /> <br />Attached to and made a part of the Excess Loss Reinsurance Treaty between San Marcos. City Of (hereinafter <br />"Company") and American National Insurance Company (hereinafter "Reinsurer") <br />Effective August 1. 2000. Treaty Number: SLOO I. <br /> <br />In consideration of the mutual covenants herein contained and intending to be legally bound hereby, the parties <br />agree as follows: <br /> <br />ARTICLE I <br />DEFINITIONS <br /> <br />The parties shall refer to the Excess Loss Reinsurance Treaty Number SLOOI (the "Treaty") for the defmitions of <br />the terminology used in this Agreement. <br /> <br />The following additional definitions shall be used in this Agreement: <br /> <br />(I) CLAIMS PAID means the total amount of benefits which Covered Persons are paid pursuant to the Plan <br />for all months in the Treaty Year, subject to any limitation in the Treaty. Claims Paid will be reduced by <br />the amount of any Specific Excess Loss Reinsurance benefits which have been or will be reimbursed by Us <br />under the Treaty. <br /> <br />(2) MONTHLY AGGREGATE RETENTION AMOUNT means the product of the number of Covered <br />Units for a particular month times the Monthly Aggregate Retention Amount Factor. <br /> <br />(3) ACCUMULATED AGGREGATE RETENTION AMOUNT means the sum of the products of the <br />Monthly Aggregate Retention Amount times the number of Covered Units in each month of the covered <br />period from the beginning of the Treaty Year to the current date. <br /> <br />(4) ACCOMMODATION means the amount paid to the Company under the provisions of this Agreement. <br /> <br />ARTICLE II <br />OPERATION <br /> <br />(I) PREMIUM PAYMENT. The Company shall pay premiums according to the terms of the Treaty. The <br />Reinsurer shall not be obligated to pay any amount of Accommodation under this Agreement if the <br />Company is in any manner delinquent or in arrears with respect to premium payments. <br /> <br />(2) CLAIM PAYMENT AND REPORTING. The Employer shall pay claims and shall meet the claims <br />reporting requirements of the Reinsurer. In the event the Employer fails to meet such claim payment and <br />reporting requirements, the Reinsurer shall not be obligated to pay any amount of Accommodation under <br />this Agreement. <br /> <br />ELT-l AAA (rev. 9/98) <br />Page 1 00 <br />
