<br />130. <br /> <br />RESOLUTION 2000- 135 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING THE TERMS AND <br />CONDITIONS OF AMENDED AND RESTATED RETAIL <br />WATER SUPPLY, WASTEWATER SERVICES, AND TAX <br />ABATEMENT AGREEMENTS BETWEEN THE CITY OF SAN <br />MARCOS AND HAYS ENERGY LIMITED PARTNERSHIP; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />AGREEMENTS; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City executed three agreements (the "Original Agreements") with Hays Energy, LP <br />in June, 1999. One was for the supply of 3.6 million gallons per day of reclaimed water (treated <br />wastewater) from the City's wastewater treatment plant to the power generation plant now under <br />construction by Hays Energy. The second was an agreement for the treatment of2.2 million gallons <br />per day of cooling process wastewater from the power plant at the wastewater treatment plant. The <br />third was a seven year tax abatement for the power plant. <br /> <br />2. Since that time, Hays Energy has revised its plans for use of the reclaimed water and will <br />now need an average of 1.5 million gallons per day instead of the 3.6 mgd stated in the Original <br />Agreements. Moreover, Hays Energy intends to install "zero liquid discharge" facilities, and will <br />only need to discharge wastewater to the City's treatment plant under emergency circumstances <br />when its own treatment facilities are not operational. <br /> <br />3. The attached agreements amend and restate the Original Agreements to adjust for these <br />changed circumstances, and to incorporate other minor revisions negotiated by the City staff with <br />Hays Energy. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The Amended and Restated Retail Water Supply Contract, the Amended and <br />Restated Wastewater Treatment Services Contract, and the Amended and Restated Tax Abatement <br />Agreement attached to this resolution are approved. <br /> <br />PART 2. The City Manager of the City of San Marcos, Larry D. Gilley, is authorized to <br />execute the Amended and Restated Retail Water Supply Contract, the Amended and Restated <br />Wastewater Treatment Services Contract, and the Amended and Restated Tax Abatement Agreement <br />attached to this resolution. <br /> <br />P ART 3.
