Section 1.7.1.1 Purpose, Applicability, Exceptions and Effect <br />(a) Purpose. The purpose of a Watershed Protection Plan shall be to apply the <br />environmental and flood control standards contained in Chapter 5 to a conceptual <br />development design. A Watershed Protection Plan assures that such standards will be met <br />at the time of development of the property by establishing terms and conditions for <br />approval of applications for plats and Site Preparation Permits. For purposes of this Code, <br />an Aquifer Protection Plan and a Site Plan for land in the San Marcos River Corridor <br />which was under prior regulations for or in association with a plat application are <br />Watershed Protection Plans. <br />(b) Applicability. Except as provided in subsections (c) or (d), approval of a <br />Watershed Protection Plan is required within the City limits or within the City's <br />extraterritorial jurisdiction prior to approval of a plat application or, for developments <br />where a plat already has been approved for the property, prior to approval of a Site <br />Preparation Permit. A Watershed Protection Plan is not required for any land that <br />is expressly exempted from the environmental standards contained in Chapter 5, Articles <br />1 -4 of the Land Development Code. <br />(ed) Effect. Approval of a Watershed Protection Plan entitles the applicant to <br />seek approval of a Cluster Development Plan, plat application or Site Preparation Permit, <br />as the case may be. <br />SECTION 5. Chapter 1, Development Procedures, Article 7, Watershed Protection <br />Plans, Division 1, Approval and Application Process; Appeals, Section 1.7.1.4, Processing of <br />Application and Decision, Subsection (a), Decision by Type of Watershed Protection Plan, is <br />amended to read as follows: <br />Section 1.7.1.4 Processing of Application and Decision <br />(a) Decision by Type of Watershed Protection Plan.
