ORDINANCE NO. 2011- 5 6 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY REZONING A 5.05 ACRE, MORE OR <br />LESS, TRACT OF LAND OUT OF THE HAYS COUNTY <br />GOVERNMENT CENTER CAMPUS AND SAN MARCOS <br />BUSINESS PARK SUBDIVISIONS, LOCATED AT WONDER <br />WORLD DRIVE BETWEEN STAGECOACH TRAIL AND <br />CORPORATE DRIVE FROM "GC" GENERAL COMMERCIAL <br />DISTRICT TO "SC -T5" SMARTCODE DISTRICT - TRANSECT 5; <br />AND INCLUDING PROCEDURAL PROVISIONS <br />RECITALS: <br />1. On October 11, 2011, the Planning and Zoning Commission of the City of San Marcos <br />held public hearings regarding requests concerning a 5.05 acre, more or less, tract of land out of <br />the Hays County Government Center Campus and San Marcos Business Park Subdivisions <br />located at Wonder World Drive between Stagecoach Trail and Corporate Drive as follows: <br />(a) to approve a Warrant under Section 1.5 of the SmartCode permitting a <br />deviation from the customary allocation of transect zones within a property having a <br />SmartCode zoning designation; and <br />(b) to change the zoning designation for said tract from "GC" General <br />Commercial District to "SC -T5" SmartCode District - Transect 5. <br />2. Subsequent to the public hearings on that date, the Planning and Zoning Commission <br />considered and voted to approve the requests on October 11, 2011, and recommended that the <br />rezoning request be approved by the City Council of the City. <br />3. The City Council held a public hearing on October 18, 2011 regarding the rezoning <br />request. <br />4. All applicable requirements of the San Marcos SmartCode and the City's Land <br />Development Code pertaining to SmartCode Zoning Map amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Official Zoning Map of the City, as described in Section 4.1.2.2 of the <br />City Land Development Code, is amended to rezone the following tract of real property from <br />"GC" General Commercial District to "SC -T5" SmartCode District - Transect 5: <br />
