Section 12.02 of the City Charter has been revised to change the terms of office and the duties <br />of the Ethics Review Commission. <br /> <br />2. Changes to the Code of Ethics ordinance (City Code Chapter 2, Article 5) are necessary to <br />correspond to the changes to the City Charter. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. Sections 2.441 and 2.443 of the City Code are amended as follows <br />(underlining indicates added text; oveIstIike indicates deleted text): <br /> <br />Sec. 2.441. Established; composition; term of members. <br /> <br />An ethics review commission is established, to be composed of seven members, all of <br />whom will reside in the city. Authority and duties. <br /> <br />(a) Generally. The ethics review commission shall act as authorized by section 12.02 of <br />the Charter concerning conflicts of interest, ethical conduct or interests of city officials and <br />employees. <br /> <br />(b) Review and recommendations. The commission will meet at least once a year to <br />review this article and may make recommendations to the city council. <br /> <br />(c) Hearings. The commission shall conduct hearings into allegations of violations ofthis <br />article. <br /> <br />(1) Any allegation by any citizen, public official or employee that a person has <br />violated this €ode article or a state conflict of interest law may be referred to any <br />member of the commission. <br /> <br />(2) A commission member receiving an allegation pursuant to this subsection may <br />request the commission to convene to review the allegation. <br /> <br />(3) The commission shall recommend to appropriate authorities cases for prosecution <br />or other action for violation of this article or a state conflict of interest law. For <br />the mayor, a city council member, a member of a city board or commission, or <br />an employee who is a council appointee, a copy of the recommendation shall be <br />provided to the city council. For employees who are not city council appointees, <br />a copy of the recommendation shall be provided to the city manager. <br /> <br />(4) The chair of the commission or any person acting in that capacity and the <br />recording secretary of the commission, are authorized to administer oaths to <br /> <br />1 <br />
