<br />171. <br /> <br />RESOLUTION 2000 - 148 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING AN EXTENSION OF THE CITY'S WASTEWATER <br />SYSTEM TO A 300 ACRE, MORE OR LESS, TRACT OF PROPERTY ON IH 35 <br />SOUTH BETWEEN CENTERPOINT ROAD AND POSEY ROAD; AND <br />PROVIDING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. City Code Section 86.003(c) requires City Council approval for the <br />extension of tne City's wastewater system to serve uses outside the City limits. <br /> <br />2. Blake Nelson (the "Owner") has requested permission to extend the <br />City's wastewater system to serve the 300 acre, more or less, tract of property on <br />IH 35 south between Centerpoint Road and Posey Road (the "Property") <br />described on the attached map, which is outside the city limits. <br /> <br />3. As is required by section 86.003(c), the Property is currently <br />receiving water through the city water system. <br /> <br />4. This wastewater extension appears to be feasible and is to be <br />constructed at the sole expense of the Owner. <br /> <br />5. The City Council is willing to approve this request on the express <br />condition that the Owner, on behalf of itself, its successors and assigns, consents <br />to the anneXd'Jn of the Property. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />PART 1. That an extension of the City's wastewater system to serve the <br />Property is approved, subject to the express condition stated in Recital 5 above. <br /> <br />PART 2. That this Resolution shall be in full force and effect from and <br />after its passage. <br /> <br />ADOPTED this 14thdayof August <br /> <br />,2000. <br /> <br />Attest <br />]/r!!
