<br />198. <br /> <br />AMENDMENT NO.1 TO TAX ABATEMENT AGREEMENT <br />BETWEEN CITY OF SAN MARCOS AND <br />TEXAS COUNTRY CLUBS, INC. <br /> <br />STATE OF TEXAS s <br />s <br />COUNTY OF HAYS S <br /> <br />The City of San Marcos, Texas, a municipal corporation organized and existing <br />under the Jaws of the State of Texas (the "City") and Texas Country Clubs, Inc. (the <br />"Developer") agree to amend Section 1.02 of their Tax Abatement Agreement entered into <br />by them on April 11 ,2000 (the "Agreement") to read as follows: <br /> <br />Section 1.02. The Developer has options to purchase the 1,101 <br />acres, more or less, area of land (the "Property") in Hays County, Texas <br />located near the intersection of Posey Road and Old Bastrop Highway, <br />comprised of the 108 acre, 436.54 acre, 67.5 acre, 107.5 acre, 74.28 acre, <br />105.612 area, 1 05.611 acre, and 96.091 acre tracts of land described as <br />Tract One through Tract Eight, inclusive of the attached Exhibit A. The <br />Property meets the eligibility criteria for tax abatement under the Policy. The <br />Property is situated within the City of San Marcos Reinvestment Zone No. <br />16 designated by separate ordinance by the City Council. This Agreement <br />will be effective only if the Developer purchases the Property by September <br />1, 2000. <br /> <br />In all other respects, except as modified above, the terms and provisions of the <br />Agreement shall remain in full force.
