AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING LOT 108 OF THE PARK ADDITION, THIRD DIVISION LOCATED IN THE 900 BLOCK OF CHESTNUT STREET FROM "MFA" MULTI- FAMILY RESIDENTIAL DISTRICT (HIGH DENSITY) TO "MF-2" MULTI-FAMILY RESIDENTIAL DISTRICT (MEDIUM DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENAL TIES. -. 0J C\J RECITALS: 1. On July 25, 2000, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "MF-4" Multi-Family Residential District (High Density) to "MF-2" Multi-Family Residential District (Medium Density) for Lot 1 08 of the Park Addition, Third Division located in the 900 Block of Chestnut Street. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on July 25, 2000 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the 11th day of Septernbp-r 2000, regarding the request. 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the follo~ing real property which is presently zoned "MFA" Multi-Family Residential District (High Density) to "MF-2" Multi-Family Residential District (Medium Density): Street address: 900 Block of Chestnut Street. Legal description: Lot 108 of the Park Addition, Third Division. Deed or plat reference: Volume 51, page 46-47, Hays County Deed Records. SECTION 2. The Future Land Use Plan ofthe San Marcos Horizons City Master Plan is revised to conform to this zoning map amendment. SECTION 3. Any person violating any prOVISIOn of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 4. After its original passage, this ordinance will be subject to reconsideration at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is reconsidered and approved, notice of its adoption will be published in a newspaper of general circulation in the City. This ordinance will take effect upon publication of this notice. PASSED, APPROVED AND ADOPTED this 11th day of September ,2000, subject to reconsideration at the next regular City Council meeting schedule for September 25, 2000.
