<br /> <br />~ <br />~ ~ <br /> <br />.~ Lw <br />~~ <br />r-1 w.J Q) <br />lZl -. <br />Q <br /> <br />84. <br /> <br />ORDINANCE 2000 - 69 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING THE ABANDONMENT OF THE <br />ALLEYWAY ADJACENT TO LOTS 1 AND 3, BLOCK 7 OF THE CEDAR <br />PLATEAU ADDITION LOCATED BETWEEN BROWN STREET AND AN <br />UNOPENED PORTION OF PROSPECT STREET; APPROVING THE <br />CONVEYANCE OF THIS ALLEYWAY TO ARTHUR AND GLORIA AMEY, <br />RETAINING A PUBLIC ACCESS EASEMENT; AUTHORIZING THE CITY <br />MANAGER TO EXECUTE A DEED; AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />RECITALS: <br /> <br />1. On August 8, 2000, 1999, the City Planning and Zoning Commission <br />conducted a public hearing on the proposed abandonment of the alleyway adjacent to Lots <br />1 and 3, Block 7, Cedar Plateau Addition located between Brown Street and an unopened <br />portion of Prospect Street, and voted unanimously to approve the proposal. <br /> <br />2. A public access easement is to be retained to link park areas. <br /> <br />3. The City has complied with the requirements of Section 272.001 (b)(2) of the <br />Texas Local Government Code regarding the conveyance of alleys for less than fair <br />market value and with Section 74.087(c) of the City Code. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The abandonment of the alleyway adjacent to Lots 1 and 3, Block 7 <br />of the Cedar Plateau Addition is approved, subject to the retention by the City of a public <br />access easement. <br /> <br />SECTION 2. The City Manager, Larry D. Gilley, is authorized to execute the <br />Quitclaim Deed attached to this ordinance conveying to Arthur and Gloria Arney the <br />alleyway described above, without cash consideration. <br /> <br />SECTION 3.
