<br />89. <br /> <br />r;~}i~LUico~ I <br />\ <br /> <br /> <br />MEMORANDUM OF UNDERSTANDING <br /> <br />This letter will serve as a Memorandum of Understanding between the City of San Marcos <br />Airport Department and the San Marcos Police Department (the "Police Departmenf') for use by the <br />Police Department of a tract of real property at the San Marcos Airport for the purpose of installing <br />improvements and conducting law enforcement training activities. <br /> <br />The parties agree as follows: <br /> <br />1. Police training will be conducted and contained within the boundaries of the area designated <br />in the line drawings attached as Exhibit A (the "Training Area"). All improvements made to <br />the Training Area by the Police Department are subject to prior written approval of the Airport <br />Manager. <br /> <br />2. The portion of the Training Area used for firearms training will be fenced in to prevent people <br />and/or livestock from entering the area. <br /> <br />3. The Police Department will be responsible for maintaining the area - mowed, free of litter and <br />debris and building clean-up. <br /> <br />4. The Police Department will be responsible for use of Training Area by other agencies. <br /> <br />5. The Police will ensure that all activities are conducted so that the use of the Training Area <br />does not constitute a nuisance to airport operations or any nearby property owner. <br /> <br />6. No police training will be conducted in the Training Area that interferes in any way with any <br />aviation use of the airport. The Airport Manager will determine whether an activity is <br />interfering with an aviation use. <br /> <br />7. If and/or when any or all of the Training Area is determined by the Airport Manager to be <br />required for any aviation use, or upon any other termination of this memorandum, the Police <br />Department will promptly remove all improvements, thoroughly clean the area, and abandon <br />the area. <br /> <br />8 The Police Department will compensate the San Marcos Airport fund at fair market value as <br />determined by the Airport Manager, for the use ofthe training. area. At the inception of this <br />memorandum, this value is agreed to be $6,OOO.OO/annually. <br /> <br />This memorandum will take effect immediately upon execution by all parties. The term will be for <br />one year from the date of execution. Unless one party notifies the other at least 90 days in advance <br />of the end of a term, this memorandum willi automatically renew for successive one-year periods <br />thereafter.
