116. RESOLUTION NO. 2000- ? 1 3R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING AN EXTENSION OF THE CITY'S WATER AND W ASTEW A TER SYSTEMS TO SERVE A PORTION OF LOT 1 OF YARRINGTON BUSINESS PARK PHASE 1; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. City Code Section 86.003(c) requires City Council approval for the extension of City water or wastewater mains to serve uses outside the City limits. 2. James H. Kelley, on behalf of Blanco River Business Center (the "Applicant"), has requested permission to extend City water and wastewater mains to serve the Applicant's property, Lot 1 of the Yarrington Business Park Phase 1, as described on the attached map (the "Property"), a portion of which is outside the city limits. 3. These main extensions appear to be feasible and are to be constructed at the sole expense of the Applicant. 4. A portion of the area of the Property that is outside the city limits is not in the City's certificated water service area, and is in the certificated service area of another water utility service provider. 5. The Applicant has submitted a written request for annexation of the Property by the City. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The extension of the City's water and wastewater system mains to serve the Property, to be constructed at the sole expense of the Applicant, and on the basis of the Applicant's request for annexation of the Property, is approved. PART 2. The approval for extension of the City's water system in Part 1 is limited to the portion of the Property that is in the City's certificated service area. PART 3.
