118. RESOLUTION NO. 2000- 214 R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING AN EXTENSION OF THE CITY'S WATER AND WASTEWATER SYSTEMS TO SERVE THE PROPOSED CAMINO REAL GOLF CLUB AND RESORT DEVELOPMENT; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. City Code Section 86.003( c) requires City Council approval for the extension of City water or wastewater mains to serve uses outside the City limits. 2. A.G. Shillaci, on behalf of Texas Country Clubs, Inc. (the "Applicant"), has requested permission to extend City water and wastewater mains to serve the Applicant's property, as described on the attached map (the "Property"), a portion of which is outside the city limits, to be developed as the Camino Real Golf Club and Resort Development. 3. These main extensions appear to be feasible and are to be constructed at the sole expense ofthe Applicant. 4. A portion of the Property is not in the City's certificated service area, and is in the certificated service area of another water utility service provider. 5. The Applicant has submitted a written request for annexation of the Property by the City. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: P ART 1. The extension of the City's water and wastewater system mains to serve the Property, to be constructed at the sole expense ofthe Applicant, and on the basis of the Applicant's request for annexation of the Property, is approved. PART 2. The approval for extension of the City's water system in Part 1 is limited to the portion of the Property that is in the City's certificated water service area. PART 3.
