<br />Office of the City Manager <br /> <br /> <br />131. <br /> <br />November 14,2000 <br /> <br />Fred Blumberg <br />Guadalupe-Blanco River Authority <br />933 East Court Street <br />Seguin, Texas 78155 <br /> <br />Dear Fred: <br /> <br />This letter, upon countersignature by an authorized GBRA official, will constitute a license <br />agreement between the City and GBRA for the installation, operation, and maintenance of one 60- <br />foot monopole antenna (the "Antenna") on the 10 foot by 10 foot tract ofland (the "Property") at the <br />location indicated on the attached Exhibit A, located near the City's San Marcos Surface Water <br />Treatment Plant site at 91 Old Bastrop Road in San Marcos, Caldwell County, Texas. This license <br />replaces the earlier license agreement on this subject dated May 19, 2000 which, upon execution of <br />this agreement,. will be deemed cancelled. This license is subject to the following terms and <br />conditions: <br /> <br />1. GBRA will comply with all federal, state and local laws,. and other regulations in setting <br />up, maintaining and operating the Antenna. GBRA will keep the Property clean and free of litter and <br />debris at all times. <br /> <br />2. GBRA will indemnify, hold harmless and defend the City and its officers and employees <br />from and against any claims or liability resulting from any act or omission of GBRA, its officers, <br />agents or employees in connection with GBRA' s use of the Property or the Antenna. GBRA also <br />will hold harmless the City, its officers, agents and employees from any claims for damage to the <br />property of GBRA resulting from any act or omission of the City, its officers, agents, or employees, <br />in connection with this Agreement. <br /> <br />3. No fee is due for GBRA' s use of the Property. <br /> <br />4. The City may terminate and revoke this License Agreement if GBRA violates this <br />agreement and fails to cure the violation within 10 days after the City gives GBRA written notice <br />of the violation.
