ORDINANCE NO. 2011- 6 9 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ANNEXING TO THE CITY AN AREA CONSISTING OF 51.14 ACRES OF LAND, MORE OR LESS, OUT OF THE WILLIAM WARD LEAGUE SURVEY, LOCATED AT 4440 OLD STAGECOACH ROAD (AT THE TERMINUS OF OLD STAGECOACH ROAD AND BLANCO VISTA BOULEVARD); APPROVING A SERVICE PLAN FOR THIS AREA; AND INCLUDING PROCEDURAL PROVISIONS. RECITALS: 1. The City Council of the City of San Marcos, Texas, provided an opportunity for all interested persons to be heard at two public hearings, held on October 4, 2011 and October 18, 2011 to consider the proposed annexation by the City of 51.14 acres of land, more or less, located 4440 Old Stagecoach Road and Blanco Vista Boulevard (at the terminus of Old Stagecoach Road and Blanco Vista Boulevard) in Hays County, Texas, consisting of the tracts of land described by metes and bounds in Exhibit "A," attached hereto and made a part hereof for all purposes (the "Annexation Area "). The location of the Annexation Area is also shown on the location map in Exhibit "B," attached hereto and made apart hereof for all purposes. 2. The public hearings were in response to a petition for annexation from the owner of the property included in the Annexation Area. 3. There are no permanent residents within the Annexation Area and no on -site public hearing has been requested by any resident. 4. A notice of each of the public hearings was published in the San Marcos Daily Record, a newspaper having general circulation in the City and in the Annexation Area. 5. The proposed Service Plan for the Annexation Area, attached hereto as Exhibit "C," and made a part hereof for all purposes, was made available for inspection and explained to the public at the public hearings. 6. The Annexation Area is contiguous and adjacent to the current boundaries of the City. 7. Notice of all meetings and deliberations of the City Council involving the annexation of the Annexation Area, including public hearings and the vote(s) on adoption of this ordinance, were done and performed in accordance with the Texas Public Information Act, Chapter 551 of the Texas Government Code, as amended. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The recitals of this ordinance are approved and adopted.
