ORDINANCE NO. 2011- 61 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE FUTURE <br />LAND USE MAP OF THE CITY FROM "MU" MIXED USE TO "HDR" <br />HIGH DENSITY RESIDENTIAL FOR A 13 ACRE, MORE OR LESS, <br />TRACT OF LAND OUT OF LOT 1, BLOCK C OF THE BLANCO <br />RIVERWALK SUBDIVISION LOCATED AT RIVERWAY AVENUE AND <br />COTTER AVENUE; AMENDING THE OFFICIAL ZONING MAP OF <br />THE CITY BY REZONING SAID TRACT OF LAND FROM "MU" <br />MIXED USE DISTRICT TO "PDD" PLANNED DEVELOPMENT <br />DISTRICT WITH BASE ZONING OF "MF -24" MULTIPLE- FAMILY <br />RESIDENTIAL DISTRICT; APPROVING PLANNED DEVELOPMENT <br />DISTRICT STANDARDS FOR THE BLANCO RIVERWALK <br />SUBDIVISION PLANNED DEVELOPMENT DISTRICT; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br />RECITALS: <br />1. On September 27, 2011 and October 25, 2011, the City Planning and Zoning <br />Commission of the City of San Marcos- held public hearings regarding a request to change the <br />Future Land Use Map of the San Marcos Horizons City Master Plan from "MU" Mixed Use to <br />"HDR" High Density Residential and a concurrent request to change the zoning from "MU" <br />Mixed Use District to "PDD" Planned Development District with base zoning of "MF -24" <br />Multiple - Family Residential District for a 13 acre, more or less, tract of land out of Lot 1, Block <br />C of the Blanco Riverwalk Subdivision located at Riverway Avenue and Cotter Avenue (the <br />"Project Site"), <br />2. Subsequent to the public hearings on such dates, the Planning and Zoning <br />Commission, on October 25, 2011 considered and voted to approve the requests, and has <br />recommended that the requests be approved by the City Council of the City of San Marcos, <br />3. The City Council held a public hearing on November 15, 2011 regarding the <br />requests. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />
