ORDINANCE NO. 2011- 6 2 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE <br />CITY BY REZONING A 149.14 ACRE, MORE OR LESS, TRACT OF <br />LAND (PHASE I OF THE PRESERVE AT WINDEMERE SUBDIVISION) <br />LOCATED ALONG LIME KILN ROAD APPROXIMATELY ONE MILE <br />NORTHWEST OF THE INTERSECTION OF LIME KILN ROAD AND <br />POST ROAD FROM "SF -R" SINGLE- FAMILY RURAL RESIDENTIAL <br />DISTRICT TO "PDD" PLANNED DEVELOPMENT DISTRICT WITH <br />BASE ZONING OF "SF -R" SINGLE - FAMILY RURAL RESIDENTIAL <br />DISTRICT; APPROVING PLANNED DEVELOPMENT DISTRICT <br />STANDARDS FOR THE PRESERVE AT WINDEMERE PHASE 1 <br />PLANNED DEVELOPMENT DISTRICT; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br />RECITALS: <br />1. On October 25, 2011, the City Planning and Zoning Commission of the City of <br />San. Marcos held a public hearing regarding a request to change the zoning from "SF -R" Single - <br />Family Rural Residential District_ to "PDD" Planned Development District with base zoning of <br />"SF -R" Single- Family Rural Residential District for a 149.14 acre, more or less, tract of land <br />located along Lime Kiln Road approximately one mile northwest of the intersection of Lime Kiln <br />Road and Post Road (the "Project Site "). <br />2. Subsequent to the public hearing on such date, the Planning and Zoning <br />Commission, on November 8, 2011 considered and voted to approve the request, and has <br />recommended that the request be approved by the City Council of the City of San Marcos. <br />3. The City Council held a public hearing on November 15, 2011 regarding the <br />request. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Official Zoning Map of the City, as described in Section 4.1.2.2 of the <br />City Land Development Code, is amended to rezone the following tract of real property, being <br />the Project Site, from "SF -R" Single - Family Rural Residential District to "PDD" Planned <br />Development District with base zoning of "SF -R" Single - Family Rural Residential District: <br />
