,,~ 200. c '<) ~ - rl ORDINANCE 2000 - 78 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING THE SALE OF A PORTION OF LOT 5, BLOCK 7, D.S. COMBS ADDITION LOCATED AT 317 JACKMAN STREET TO HABITAT FOR HUMANITY - SAN MARCOS AREA; AUTHORIZING THE CITY MANAGER TO EXECUTE A SPECIAL WARRANTY DEED; AND PROVIDING AN EFFECTIVE DATE. RECITALS: 1. The City is the owner of a portion of Lot 5, Block 7, D.S. Combs Addition. 2. A staff analysis has been made that has determined that there is no present or anticipated future need for the City to retain this property. 3. The City has complied with the requirements of Section 272.001 (b)(1) of the Texas Local Government Code regarding the sale of surplus real property by sealed bidding and the high bidder for the purchase of this tract of property is the Habitat for Humanity - San Marcos Area. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The sale of the parcel of real property described in Recital 1 above to Habitat for Humanity - San Marcos Area is approved. SECTION 2. The City Manager, Larry D. Gilley, is authorized to execute the attached Special Warranty Deed conveying to Habitat for Humanity - San Marcos Area the property described above. SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in full force if they can be given effect without the invalid portion. SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 5. This Ordinance will take effect 10 days after the date of its final passage, and the City Secretary will publish notice of its adoption in a newspaper of general circulation in the City.
