<br />,,~ <br /> <br /> <br />200. <br /> <br /> <br />c <br />'<) <br />~ <br />- <br />rl <br /> <br />ORDINANCE 2000 - <br /> <br />78 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING THE SALE OF A PORTION OF LOT 5, <br />BLOCK 7, D.S. COMBS ADDITION LOCATED AT 317 JACKMAN STREET <br />TO HABITAT FOR HUMANITY - SAN MARCOS AREA; AUTHORIZING <br />THE CITY MANAGER TO EXECUTE A SPECIAL WARRANTY DEED; AND <br />PROVIDING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City is the owner of a portion of Lot 5, Block 7, D.S. Combs Addition. <br /> <br />2. A staff analysis has been made that has determined that there is no present or <br />anticipated future need for the City to retain this property. <br /> <br />3. The City has complied with the requirements of Section 272.001 (b)(1) of the Texas <br />Local Government Code regarding the sale of surplus real property by sealed bidding and <br />the high bidder for the purchase of this tract of property is the Habitat for Humanity - San <br />Marcos Area. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The sale of the parcel of real property described in Recital 1 above <br />to Habitat for Humanity - San Marcos Area is approved. <br /> <br />SECTION 2. The City Manager, Larry D. Gilley, is authorized to execute the <br />attached Special Warranty Deed conveying to Habitat for Humanity - San Marcos Area <br />the property described above. <br /> <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance <br />is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br />provisions of this ordinance will continue in full force if they can be given effect without the <br />invalid portion. <br /> <br />SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions <br />in conflict with this ordinance are repealed. <br /> <br />SECTION 5. This Ordinance will take effect 10 days after the date of its final <br />passage, and the City Secretary will publish notice of its adoption in a newspaper of <br />general circulation in the City. <br />
