<br />205. <br /> <br />RESOLUTION NO. 2000- 236 R <br /> <br />A RESOLCTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF A PROPERTY <br />EXCHANGE AGREEMENT BETWEEN THE CITY AND SOUTHWEST TEXAS <br />STATE UNIVERSITY PERTAINING TO THE CITY'S SESSOM <br />DRIVEIUNIVERSITY DRIVE INTERSECTION IMPROVEMENTS PROJECT; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT ON <br />BEHALF OF THE CITY AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City owns the tract of real property (the "City Tract") described in the Exhibit A to <br />the Agreement attached to this resolution. Southwest Texas State University ("SWT") wishes to <br />acquire the City Tract to provide for the construction of a new ArtITechnologylPhysics facility (the <br />"ATP Facility") on a portion of the City Tract and on adjacent property ofSWT. <br /> <br />2. SWT owns the parcels of real property in San Marcos, Hays County, Texas, depicted in <br />Exhibit B to the Agreement attached to this resolution. The City wishes, subject to certain <br />contingencies, to acquire portions (the "SWT Tracts") of these parcels of property to provide for the <br />construction of improvements to the intersection of Sessom Drive with University Drive (the <br />"Intersection Improvements"). <br /> <br />3. The City and SWT desire to exchange the City Tract for the SWT Tracts on the terms and <br />conditions contained in this Agreement. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />P ART 1. The attached Property Exchange Agreement between the City of San Marcos and <br />Southwest Texas State University is approved. <br /> <br />PART 2. The City Manager, Larry D. Gilley, is authorized to execute the agreement on <br />behalf of the City. <br /> <br />PART 3.
