<br />I <br /> <br />~ 1251 et seq., the Clean Air Act, 42 US.C., Section 7401 et seq., the Toxic <br />Substances Control Act, 15 V.S.C. ~ 2601 et seq., the Safe Drinking Water Act, 42 <br />US.C. ~ 300(f) et seq., and any and all regulations promulgated thereunder, or any <br />similar federal, state or local laws, ordinances or regulations adopted under these acts. <br /> <br />(d) TankslWells. To the best of Seller's knowledge, which the parties agree <br />does not obligate Seller to independently conduct an investigation or inspection of the <br />Property for purposes of the representations and warranties set forth in this Section <br />5 .4( d), there have not been and there are not now any underground or aboveground <br />storage tanks, dipping tanks, septic tanks or wells located on or under the Property, or if <br />there have been or are any such tanks or wells located on the Property their location bas <br />been identified to Purchaser in writing, they have been properly registered with all <br />appropriate authorities, they are in full compliance with all applicable statutes, ordinances <br />and regulations, and they have not resulted in the release of any Hazardous Substance <br />into the environment. <br /> <br />(e) Government Farm Prolrrams. The Property is not enrolled in the Direct <br />and Countercyclical Payment Program, the Conservation Reserve Program, the Wetland <br />Reserve Program or any other program of the United States Department of Agriculture. <br />The Property is not subject to any government cost-share contracts or other agreements <br />that restrict either the use of the Property or the modification of any improvements. <br /> <br />I <br /> <br />(f) Conflict of Interest. In order to assist Purchaser in identifying potential <br />conflicts of interest, Seller has completed, signed and delivered to Purchaser a disclosure <br />form (the "Disclosure Form'') regarding any relationship Seller might have with <br />Purchaser, as more particularly described therein. Seller warrants and represents to <br />Purchaser that the information in the Disclosure Form is, to the best of Seller's <br />knowledge, true and correct. Seller shall promptly notify Purchaser in writing if any <br />change in circumstances occurs prior to Closing that would change any response on the <br />Disclosure Form. In the event that any answer on the Disclosure Form changes prior to <br />Closing, or in the event that any material misrepresentation or misstatement in the <br />Disclosure Form is discovered before closing, Purchaser may elect to declare this <br />Contract null and void, in which case the Earnest Money shall be r~turned to Purchaser. <br /> <br />Section 5.5 Certification Regarding Material Suoport and Resources to <br />Terrorists. <br /> <br />(a) Seller hereby certifies: <br /> <br />(i) Seller does not and will not engage in, advocate, commit, facilitate, <br />or support any terrorist acts. <br /> <br />(ii) Seller will take all reasonable steps to ensure that Seller does not <br />and will not knowingly provide, material support or resources to any individual or entity <br />that commits, attempts to commit, advocates, facilitates, or participates in terrorist acts, <br />or has committed, attempted to commit, facilitated, or participated in terrorist acts. <br /> <br />I <br /> <br />-7- <br />
