It shall not be necessary that the signature ur <br />acknowledgment ot; or on behalf of; each party, or that the signah>Ire of all persons required to <br />bind any party, or the acknowledgment of such party, appear on each co>.uiterpart. All <br />counterparts sh~~li collectively constitute a single instrument. <br />1~. Amendments. This Agreement may not he modified orally or in any mamiex <br />other than by an agreement, in writing, signed by the parties hereto or their respective successors <br />in interest. <br />13, Successors and Assi ns. This Agreement shall inure to the benefit of and be <br />binding uupon the parties hereto, their successors and assigns; provided, however, the foregoing <br />shall not be deemed or construed as constituting Landlord's consent to any further transfer of <br />Tenant's interest in and to the Lease or the Property other than as expressly provided herein. <br />14. Time is of the r;ssence. Each of Landlord, Tenant and Mortgagee acknowledges <br />that time is of the essence with respect to all ofthc parties' obligations hereunder. <br />1.5.
