<br />102. <br /> <br />INTERLOCAL AGREEMENT <br />CITY OF SAN MARCOS AND TEXAS STATE UNIVERSITY - SAN MARCOS <br />COLLECTION AND ANALYSIS OF ORGANIC WASTEWATER CONTAMINANTS <br /> <br />I STATE OF TEXAS <br /> <br />COUNTY OF HAYS <br /> <br />The City of San Marcos ("City") and Texas State University - San Marcos ("Texas <br />State"), Edwards Aquifer Research and Data Center ("EARDC") enter into this Interlocal <br />Agreement under the authority of the Interlocal Cooperation Act, Chapter 791 of the Texas <br />Government Code, as amended. <br /> <br />Section 1. Purpose of Aereement <br /> <br />The purpose of this Agreement is for the collection and analysis of data in connection <br />with the City's Organic Wastewater Contaminant ("OWC") Sampling Plan by Texas State. <br />Texas State and the City agree that this agreement serves a public purpose in that it will provide <br />background information related to the occurrence of these compounds, the treatment system <br />effectiveness, and profile characteristics of reclaimed water over or near the Edwards Aquifer <br />Recharge Zone, and to determine if additional sampling is appropriate. <br /> <br />Section 2. Scope of Services <br /> <br />I <br /> <br />a) Texas State agrees to provide data collection and analysis of endocrine disrupter <br />chemicals for the City in accordance with the attached Scope of Services (Attachment A). <br /> <br />b) The City agrees to pay Texas State $39,191.00 for the satisfactory performance of <br />its services under this Agreement. The City will pay $37,231.45 in 12 monthly installments of <br />$3,102.62, and a final payment of $1,959.55 upon Texas State's submission and the City's <br />acceptance and approval of the final report which is due May 10, 2007. <br /> <br />Section 3. Term <br /> <br />The term of this Agreement will commence on February 8, 2006 and will continue untIl <br />May 10, 2007 unless terminated by either party in accordance with Section 4(g). <br /> <br />Section 4. Miscellaneous Provisions <br /> <br />a) Interlocal Cooperation: The City and Texas State agree to cooperate with each <br />other in good faith at all times during the term of this Agreement in order to achieve the purpose <br />of this Agreement. Each party to this Agreement acknowledges and represents that this <br />Agreement has been executed by its duly authorized representative. <br /> <br />I <br /> <br />b) Entire Agreement: This Agreement contains the entire agreement between the <br />parties and supersedes all prior understandings and agreements between the parties regarding <br />such matters. This agreement may not be modified or amended except by written agreement <br />executed by both parties. Neither party may assign this Agreement without the written consent <br />of the other party. <br /> <br />Interlocal TxState- Testing 2006 <br />
