RESOLUTION NO. 2006- 28 R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, GRANTING RECOGNITION OF THE SAN MARCOS PROFESSIONAL FIREFIGHTERS ASSOCIATION LOCAL #3963 AS THE SOLE AND EXCLUSIVE BARGAINING AGENT FOR CITY FIREFIGHTERS, AND DETERMINING THAT THE CITY MAY MEET AND CONFER WITH THE ASSOCIATION WITHOUT CONDUCTING AN ELECTION BY THE VOTERS IN THE CITY; DIRECTING THE CITY MANAGER TO SUBMIT A REPORT ON THE STATUS OF MEET AND CONFER; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The City Clerk received a petition on January 19, 2006 from the San Marcos Professional Firefighters Association Local #3963 (the "Association") requesting recognition as the sole and exclusive bargaining agent for City firefighters, and determining that the City may meet and confer with the association without conducting an election by the voters in the City. 2. Under State law (Local Government Code Sec. 142.053(a) and Sec. 142.103(a)), the City Council is required to either a) approve the petitions and recognize the Association as the sole and exclusive bargaining agents for City firefighters, or b) call certification elections to confirm that a majority of firefighters wish to be represented by the Association, or c) refer to City voters the issue of whether to approve the petition and recognize the Association as the sole and exclusive bargaining agents for City firefighters. 3. The City Council wishes to approve the petitions and recognize the Association as the sole and exclusive bargaining agents for City firefighters, without conducting an election by the voters in the City. 4. The City Council wishes to review the status of the recognition granted to the Association, and of meet and confer discussions with the Association, after a period of one year. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: P ART 1. The City Council grants recognition to the San Marcos Professional Firefighters Association Local #3963 as the sole and exclusive bargaining agent for City firefighters, and determines that the City may meet and confer with the Association without conducting an election by the voters in the City. PART 2. The City Manager, Dan O'Leary, is directed to present a report to the City Council after the first anniversary of the adoption of this resolution, reviewing the status of the recognition granted to the Association, and of meet and confer discussions with the Association. P ART 3. This resolution is in effect immediately upon its adoption.
