<br />I <br /> <br />I <br /> <br />I <br /> <br />11 7 . <br /> <br />RESOLUTION NO. 2006- 29 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, GRANTING RECOGNITION OF THE SAN MARCOS <br />POLICE OFFICERS ASSOCIATION AS THE SOLE AND EXCLUSIVE <br />BARGAINING AGENT FOR CITY POLICE OFFICERS, AND <br />DETERMINING THAT THE CITY MAY MEET AND CONFER WITH <br />THE ASSOCIATION WITHOUT CONDUCTING AN ELECTION BY THE <br />VOTERS IN THE CITY; DIRECTING THE CITY MANAGER TO <br />SUBMIT A REPORT ON THE STATUS OF MEET AND CONFER; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City Clerk received a petition on January 19, 2006 from the San Marcos Police <br />Officers Association (the "Association") requesting recognition as the sole and exclusive bargaining <br />agent for City police officers, and determining that the City may meet and confer with the <br />Association without conducting an election by the voters in the City. <br /> <br />2. Under State law (Local Government Code Sec. 142.053(a), the City Council is required to <br />either a) approve the petition and recognize the Association as the sole and exclusive bargaining <br />agents for City police officers, or b) call a certification election to confirm that a majority of police <br />officers wish to be represented by the Association, or c) refer to City voters the issue of whether to <br />approve the petition and recognize the Association as the sole and exclusive bargaining agent for <br />City police officers. <br /> <br />3. The City Council wishes to approve the petition and recognize the Association as the sole <br />and exclusive bargaining agent for City police officers, without conducting an election by the voters <br />in the City. <br /> <br />4. The City Council wishes to review the status ofthe recognition granted to the Association, <br />and of meet and confer discussions with the Association, after a period of one year. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The City Council grants recognition to the San Marcos Police Officers Association <br />requesting recognition as the sole and exclusive bargaining agent for City police officers, and <br />determines that the City may meet and confer with the Association without conducting an election by <br />the voters in the City. <br /> <br />PART 2. The City Manager, Dan O'Leary, is directed to present a report to the City Council <br />after the first anniversary of the adoption of this resolution, reviewing the status of the recognition <br />granted to the Association, and of meet and confer discussions with the Association. <br /> <br />P ART 3. This resolution is in effect immediately upon its adoption. <br /> <br />J <br />
