INTERLOCAL AGREEMENT <br />BETWEEN THE CITY OF BUDA AND THE CITY OF SAN MARCOS <br />FOR THE PROVISION OF ANIMAL SHELTER SERVICES <br />STATE OF TEXAS <br />COUNTY OF HAYS <br />The City of San Marcos ( "San Marcos ") and the City of Buda ( "Buda "), enter into this <br />Interlocal Agreement under the authority of the Interlocal Cooperation Act (the "Act "), Chapter <br />791 of the Texas Government Code, as amended for San Marcos' provision of animal shelter <br />services through the City of San Marcos Animal Shelter (the "Shelter "). This Agreement is <br />effective as of January 3, 2012. <br />San Marcos and Buda understand that the San Marcos Animal Services Division <br />currently operates and maintains a centralized animal shelter that is charged with responding to <br />calls for service regarding animals ( "dogs and cats ") and protecting public property from animal - <br />related damage. The Shelter will accept animals from Buda during normal business hours, 8:00 <br />a.m. until 5 p.m. Monday — Friday and from 11:30 a.m. until 4:30 p.m. on Saturdays. Buda will <br />not have access to the Shelter after regular business hours. <br />Both the parties anticipate that this cooperative partnership will accomplish the following <br />goals beneficial to all residents of Buda, Texas: <br />Proper care of animals and response to animal related issues; <br />Mutual concern for controlling expenses related to animal shelter services; and <br />Utilization of euthanasia by injection as the preferred method for the destruction of <br />animals. <br />Section 1. Scope of Services <br />A. San Marcos Agreements: <br />San Marcos agrees to: <br />1. Designate Bert Stratemann, the City of San Marcos Animal Services Manager, as the <br />San Marcos representative in all matters related to this Agreement. <br />2. Maintain the Shelter as a State approved rabies quarantine facility. <br />3. Receive and shelter animals delivered from Buda as of the effective date of this <br />Agreement. San Marcos will not provide animal control services to Buda. Both <br />parties anticipate that the Shelter will receive a total of 250 additional animals from <br />Buda on an annual basis, and costs to Buda under this Agreement are based on this <br />estimate. Animals received by the Shelter in excess of 250 per year will be accepted <br />on a per animal cost basis. The Shelter does not accommodate livestock. <br />4. Provide a quarterly sheltering report to Buda. <br />
