AMENDMENT TO INTERLOCAL AGREEMENT <br />This amendment (the "Amendment ") is entered into by and between the City of San <br />Marcos, Texas (the "City ") and Hays County, Texas (the "County ") and amends that certain <br />Interlocal Agreement between dated January 9, 2009 by and between the City and the County. <br />1. On January 9, 2009, the City and the County entered into an interlocal agreement <br />with Hays County, Texas (the "Agreement ") to expend up to $3,100,000.00 of general obligation <br />bond funds issued by the County for the purpose of making certain park improvements to five <br />parks in the City of San Marcos and Hays County, with an equivalent match in funds, real <br />property and /or in kind contributions from the City. <br />2. One of the projects identified under the Agreement was the Purgatory Creek <br />Preserve for which up to $1,600,000.00 of County funds were allocated. <br />3. The City has been presented with an opportunity to expand the Purgatory Creek <br />Preserve by purchasing additional adjacent land. Such purchase would require increased funding <br />from the County under the Agreement in the amount of $300,000.00. <br />4. The City and the County wish to amend the Agreement to provide for such <br />increase in funding to enable such land purchase. <br />5. For the reasons stated above, the Agreement is hereby amended as follows: <br />a. page two of Exhibit A, entitled "PROJECT #2: PURGATORY CREEK <br />PRESERVE PARK IMPROVEMENTS" shall be deleted and replaced with the attached <br />exhibit bearing the same title for the purpose of increasing the County's contribution for <br />the Purgatory Creek Preserve Project by $300,000,00; and <br />b. the County's total contribution of bond funds under applicable provisions <br />of the Agreement is adjusted from $3,100,000,00 to $3,400,000.00 to reflect the <br />additional funding for the Purgatory Creek Preserve Project. The $300,000 difference <br />represented by this adjustment shall be paid by the County within 30 days of the effective <br />date of this Amendment. <br />6. All other terms and conditions of the Agreement remain the same. <br />1 <br />
