56. <br /> <br />RESOLUTION 2004 - 202R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING THE PURCHASE OF A UTILITY <br />EASEMENT FROM JAIME J. RUSSEK MARTINEZ IN CONNECTION <br />WITH THE CAMINO REAL TRANSMISSION IMPROVEMENTS <br />PROJECT; AND DECLARING AN EFFECTIVE DATE. <br />1 <br />RECITALS: <br />1. The Camino Real Transmission Improvements Project (Phases 1 & 2) involves the <br />installation of a large diameter transmission main between the Surface Water Treatment Plant <br />and State Highway 123. This project is required to provide water service to the southeastern <br />areas of the City, including the proposed high school site. <br />2. Mr. Jaime J. Russek Martinez is the owner of the tract of real property located in the <br />project area fronting both State Highway 123 and Redwood Road. Mr. Martinez has executed <br />the attached utility easement allowing for the installation of the project water pipeline condition <br />upon City Council approval of the consideration of $36,957.36. <br />3. The City staff recommends approval of the terms of the attached letter agreement and <br />completion of this acquisition. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />PART 1. That the purchase of the attached Letter Agreement and Utility Easement <br />for the consideration of $36,957.35, is approved. <br />PART 2.
