Russek Martinez, Paseo del Bosque #5, Col Campestre la Rosita, Torreon, Coahuila, <br />27250 Mexico <br />Grantee: City of San Marcos, Texas, 630 E. Hopkins Street, San Marcos, Hays County, TX 78666 <br />Consideration: Ten Dollars ($10.00) and other valuable consideration. <br />Property: Two parcels as more specifically described on the attached Exhibit `A' and Exhibit `B' <br />Reservations from and Exceptions to Conveyance and Warranty: This conveyance is made and accepted <br />subject to any and all restrictions, covenants, conditions, and easements, if any, relating to the property, but <br />only to the extent they are still in effect, and are shown of record in the county and state in which the property <br />'s located. <br />Grantor, for the consideration, grants, sells and conveys to the Grantee an easement within, across, through and <br />over the property for the purposes of constructing, laying, installing, reconstructing, replacing, operating and <br />maintaining one or more potable water lines, and valves, manholes, connections, monitoring devices, and other <br />associated equipment and appurtenances, together with a right of ingress and egress at all times to, across, over <br />and within the property for these purposes, to have and to hold this easement to Grantee and Grantee's <br />successors or assigns forever. Grantor binds Grantor and Grantor's heirs, executors, administrators, successors <br />and assigns to warrant and forever defend this easement to Grantee and Grantee's successors and assigns <br />against every person whomever lawfully claiming or to claim the same or any part thereof. <br />SPECIAL TERMS: <br />1) It is further understood and agreed that Grantor also grants, bargains, sells and conveys unto <br />Grantee a temporary easement and right-of-way in connection with the laying and constructing of <br />the Pipeline (the "Temporary Easement"). The Temporary Easement shall allow Grantee to use <br />the Temporary Easement Area (defined below) to perform the construction of the Pipelines as <br />provided under the perpetual Easement granted above. The "Temporary Easement Area" is forty <br />feet (40') in width adjoining the Easement as illustrated on the attached plats, part of Exhibit `A' <br />and Exhibit V. It is understood and agreed that the Temporary Easement shall expire upon the <br />completion of the construction of the Pipelines and restoration of the Easement area and the <br />Temporary Easement Area
